• AI technologies evolve rapidly. We are not responsible for changes made by AI platforms that may affect the relevance of our training.

• Our materials are protected by copyright. You may use them within your organization but may not share tools or materials with non-members without written permission.

• Testimonials represent individual experiences and are not guarantees of typical results. Most people who purchase educational content achieve limited or no results.

1. INTRODUCTION

These Terms and Conditions ("Terms") govern your access to and use of the Everyday AI Magic membership services ("Service") provided by Intelligent Marketing Content LLC ("Company," "we," "us," or "our"). By subscribing to or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. SERVICE DESCRIPTION

The Everyday AI Magic membership provides access to a library of CustomGPTs through ChatGPT links. These CustomGPTs are designed to assist with various AI-powered tasks and functionalities as described in your membership materials.

3. ACCOUNT REGISTRATION AND REQUIREMENTS

3.1 To access the Service, you must create and maintain an account with valid and current information.

3.2 You must be at least 18 years old to use the Service.

3.3 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.4 Upon successful completion of your purchase, you will receive access to the CustomGPT links. If you do not receive your access within 24 hours, please check your spam folder or contact us for assistance.

4. MEMBERSHIP AND PAYMENT

4.1 Membership fees, billing cycles, and payment methods are described during the sign-up process.

4.2 Unless otherwise stated, memberships automatically renew at the end of each billing cycle.

4.3 You may cancel your membership at any time through your account settings or by contacting our customer support.

4.4 No Refund Policy: Due to the nature of digital products, all sales are final. Once the CustomGPT links have been provided, they cannot be "undelivered" or returned. As such, Intelligent Marketing Content LLC does not offer refunds, exchanges, or cancellations for this purchase. By completing your order, you acknowledge and accept this no-refund policy.

5. USAGE RESTRICTIONS AND RESPONSIBILITIES

5.1 CustomGPT Access Links: The CustomGPT links provided through your membership are for your personal use only. You are strictly prohibited from sharing these links with non-members or individuals who do not have an active Everyday AI Magic membership.

5.2 You agree not to:

Reverse engineer, decompile, or disassemble any aspect of the Service

Use the Service for any illegal purpose

Attempt to gain unauthorized access to any portion of the Service

Use the Service in any manner that could damage, disable, overburden, or impair the Service

5.3 You are responsible for compliance with all applicable laws and regulations when using the Service.

6. INTELLECTUAL PROPERTY

6.1 All content, trademarks, service marks, logos, and other intellectual property rights related to the Service are owned by the Company or its licensors.

6.2 Your membership grants you a limited, non-exclusive, non-transferable license to access and use the Service for its intended purposes.

6.3 All content within the CustomGPT library is the intellectual property of Intelligent Marketing Content LLC and is protected under copyright law. You are granted a personal, non-transferable, non-exclusive license to use the content for your own business or personal use.

6.4 You may not distribute, resell, or share the CustomGPT links or content with third parties or non-members without explicit written permission from Intelligent Marketing Content LLC.

7. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

7.1 Service Reliability: Intelligent Marketing Content LLC is not responsible for any functionality issues, changes, or limitations that may affect the CustomGPTs due to:

Changes or updates to the ChatGPT platform

Server overload or downtime

Technical issues with OpenAI's services

Changes in OpenAI's policies or terms of service

Any other factors beyond our reasonable control

7.2 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.3 TO THE FULLEST EXTENT PERMITTED BY LAW, INTELLIGENT MARKETING CONTENT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE

ANY CONTENT OBTAINED FROM THE SERVICE

UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

7.4 IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE DURING THE PAST SIX (6) MONTHS.

8. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Intelligent Marketing Content LLC, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

9. THIRD-PARTY SERVICES

9.1 The Service utilizes OpenAI's ChatGPT platform. Your use of CustomGPTs is also subject to OpenAI's terms of service and privacy policy.

9.2 We are not responsible for the content, privacy policies, or practices of any third-party services, including ChatGPT.

10. CHANGES TO TERMS AND UPDATES

10.1 We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website or notification through the Service.

10.2 Your continued use of the Service after such modifications constitutes your acceptance of the revised Terms.

10.3 Intelligent Marketing Content LLC reserves the right to modify, update, or discontinue any of the CustomGPTs or the Service at any time without prior notice. Any future updates may be subject to additional fees at our discretion.

11. TERMINATION

11.1 We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

11.2 Upon termination, your right to use the Service will immediately cease.

12. GOVERNING LAW AND DISPUTE RESOLUTION

12.1 These Terms shall be governed by the laws of the State of Michigan, without regard to its conflict of law provisions.

12.2 Any dispute arising from or relating to these Terms or the Service shall be resolved through arbitration in accordance with the rules of the American Arbitration Association.

13. MISCELLANEOUS

13.1 These Terms constitute the entire agreement between you and the Company regarding the Service.

13.2 If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

13.3 Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 You agree that the Company's owners, officers, or directors are not personally liable for any claims related to these services; your agreement is with Intelligent Marketing Content LLC.
